Terms of Service

1. Acceptance of these terms

By using our website, submitting an enquiry, creating a booking or paying for a service, you agree to these Terms of Service and our Privacy Policy. If you book for other travellers, you confirm that you are authorised to provide their information and accept applicable terms on their behalf.

2. Enquiries and bookings

Website availability, package descriptions and departure details are invitations to enquire or book. A booking becomes confirmed only when we issue written confirmation after receiving the required information and payment. Open departures may collect interest without guaranteeing a departure or reservation.

You are responsible for checking names, dates, traveller details, selected seats or slots, accommodation and other information before payment and again on confirmation.

3. Prices and payments

Prices are shown in the stated currency and may be subject to availability, exchange-rate movements, taxes, park fees, supplier changes and clearly disclosed supplements. Payment is due by the deadline stated during checkout, in an invoice or in a written quotation.

Payments may be processed by third-party providers. Their processing terms may also apply. A payment reference alone does not confirm a booking where payment is pending, reversed, incomplete or cannot be matched to the booking.

4. Changes, cancellations and refunds

Package-specific cancellation, amendment and refund conditions shown in your quotation, invoice, checkout or confirmation form part of these terms. Supplier penalties, non-refundable items and administrative costs may apply. Where a refund is approved, it will normally be returned through an appropriate available method after applicable deductions.

We may make reasonable itinerary or supplier changes where operational, safety, weather, regulatory or availability issues require them. If a material change occurs, we will communicate the available options as soon as reasonably practicable.

5. Travel documents and traveller responsibilities

You are responsible for:

• valid passports, identification, visas, permits, vaccinations and entry or transit requirements;
• accurate health, mobility, dietary and other information relevant to safe service delivery;
• appropriate travel insurance;
• complying with laws, supplier rules, safety instructions and agreed departure times; and
• behaving responsibly toward other travellers, staff, communities, wildlife and property.

6. Third-party services

Hotels, airlines, transport operators, guides, parks, payment providers and other suppliers may provide parts of your trip under their own terms. We select and coordinate suppliers with reasonable care, but circumstances outside our reasonable control may affect their services.

7. Website and communications

You must not misuse the website, attempt unauthorised access, interfere with its operation, submit false information or use it for unlawful activity. Website content, branding and original materials belong to Gofan Safaris or their respective licensors and may not be commercially reproduced without permission.

You agree that we may send booking and service communications by email, telephone, SMS or WhatsApp using the contact details you provide. Service messages are separate from optional marketing communications.

8. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded. To the extent permitted by law, Gofan Safaris is not responsible for losses caused by inaccurate traveller information, failure to obtain travel documents, acts of independent suppliers, or events beyond our reasonable control.

9. Governing law

These terms are governed by the laws of Kenya. We encourage you to contact us first so that we can try to resolve any concern promptly. Any dispute not resolved directly will be handled by the courts or other competent dispute-resolution bodies in Kenya.
